If a dispute arises as to ownership of an animal and a lawsuit is commenced, the court will consider the evidence and determine rights. The court may consider not only who purchased the animal, but under whose name an animal is registered (such as microchip, license, and veterinary records), and whether either of the parties gifted, sold, abandoned, or mistreated the animal. I cannot predict the outcome of any given pet custody case. It is usually far better for the individuals who care about their animal to work out a custody/visitation arrangement in the animal’s best interests.
